Board of Appeals

Warren’s Board of Appeals plays a key role in ensuring fair and flexible application of the Town’s Land Use and Development ordinances. Comprised of knowledgeable and dedicated community volunteers, the Board offers property owners and applicants a clear, structured avenue to seek relief from overly rigid requirements—while still aligning with Warren’s spirit of thoughtful growth and neighborhood safety.

What the Board Does

  • Hears Variance Requests: When strict enforcement of setback, lot frontage, or minimum-yard rules would cause undue hardship, the Board can grant special permission—known as a variance—so long as certain legal criteria are met.

  • Considers Appeals: Property owners have the right to challenge decisions made by municipal officials (e.g., the Code Officer). The Board reviews these cases, examines facts, and issues binding decisions.

  • Interprets Ordinance Provisions: If an ordinance’s language is unclear, the Board can clarify meaning and application to support consistent and predictable outcomes.

Why It Matters

  • Promotes Property Rights: The Board provides a fair channel for residents to seek relief from regulatory constraints that might otherwise prohibit reasonable development.

  • Ensures Orderly Growth: Decisions are made transparently and based on clear standards—not arbitrary policy—preserving neighborhood stability and community character.

  • Supports Responsible Development: The Board balances private property interests with the public good through thoughtful case-by-case review.
